Welcome to Creative Nexus (“Company”, “we”, “us”, or “our”). By accessing our website (https://creativenexusindia.com) or purchasing our creative services, you (“Customer”, “User”, “You”) agree to be bound by the Terms & Conditions outlined in this document.

These Terms govern your access to our website, communication platforms, and all creative services provided by Creative Nexus, including but not limited to presentation design, pitch deck development, corporate communication design, product launch decks, and related consulting services (“Services”).

Please read these Terms carefully. If you do not agree with them, you must discontinue the use of our website and services immediately.

Creative Nexus reserves the right to update these Terms at any time without prior notice. Your continued use of the site or services indicates your acceptance of the updated Terms.

1. GENERAL DEFINITIONS

For the purpose of these Terms:

  • “Customer”, “User”, “You” refers to any person or legal entity using our website or purchasing our services.
  • “Company”, “We”, “Us”, “Creative Nexus” refers to Creative Nexus and its subsidiaries or authorized representatives.
  • “Platform” refers to our website, systems, communication channels, and any digital tools used to deliver services.
  • “Services” refers to all creative, design, strategy, and presentation-related services offered by Creative Nexus.

To use our Services, you must:

  • Be 18 years or older, or have guardian consent if 13–17.
  • Have legal capacity to form binding contracts.
  • Not be prohibited from receiving services under applicable law.

2. CONTRACT FORMATION

A project between Creative Nexus and the Customer is established as follows:

2.1 Request & Quotation

You provide your project brief, draft content, slides, or requirements.
We then share a quotation, scope, and delivery timeline, which serves as an offer.

2.2 Acceptance & Payment

A binding agreement is formed when:

  • You accept the quotation, and
  • Make the required advance payment.

Quotes may change if project scope expands, unclear content requires reinterpretation, or additional services are requested.

2.3 Project Activation

The contract becomes active once Creative Nexus provides written confirmation (email/message).

3. SERVICES & DELIVERY

3.1 Delivery Format

Deliverables are provided in formats such as:

  • PPT, PPTX, PDF,DOCX or other formats mutually agreed upon.

3.2 Revision Policy

Each project includes three (3) free revisions, covering:

  • Design refinements
  • Layout improvements
  • Corrections based on the initial scope

Revisions do not include:

  • New content
  • New ideas
  • Additional slides
  • Scope expansion

Additional revisions will be billed separately.

3.3 Approval Process

Upon delivery, the Customer must review the work and share feedback within 3 days.
Failure to respond within this period will be considered automatic approval.

Once approved (explicitly or automatically), the work cannot be rejected, and the contract is deemed completed.

4. CUSTOMER RESPONSIBILITIES

You must provide all required materials, including:

  • Written content
  • Brand guidelines
  • Images, icons, logos
  • Product information
  • Reference files
  • Required access or direction

Delays in submitting materials may extend project timelines.
Creative Nexus is not liable for delays caused by incomplete or unclear customer inputs.

5. PROJECT DELAYS & COOPERATION

Timelines are based on the assumption of:

  • Timely customer responses
  • Complete content submission
  • A dedicated point of contact on the client’s side

Creative Nexus is not responsible for delays resulting from customer inaction.

6. ADDITIONAL SERVICES & SCOPE CHANGES

Any work beyond the agreed scope—including new design requests, additional slides, content editing, restructuring, or repeated revisions—will be charged separately.

We will notify the Customer before starting additional work and share a revised quotation.

7. SERVICE AVAILABILITY

Our production team operates Monday to Friday, following the Indian holiday calendar.

Service availability may vary across:

  • India (primary production)
  • US and International Offices (client communication)

We aim to meet all deadlines, but do not guarantee uninterrupted availability due to maintenance, upgrades, or unforeseen issues.

8. PAYMENT TERMS

Creative Nexus accepts 100% upfront payment for all project-based services unless otherwise agreed in writing.

No work will commence until payment is received.

Payments once made are non-refundable, except under the applicable Refund Policy (separate page).

9. SUBCONTRACTING

Creative Nexus reserves the right to assign or subcontract any part of the project to qualified partners or freelancers.

All subcontractors are bound by strict confidentiality agreements.

10. LICENSING & INTELLECTUAL PROPERTY

Upon receipt of full payment, Creative Nexus grants the Customer a non-exclusive, non-transferable license to use the final deliverables for their intended business purpose.

Creative Nexus retains:

  • Ownership of design processes
  • Layouts
  • Creative assets used in production
  • Non-sensitive structural templates

Customer-provided content remains the property of the Customer.

11. CONFIDENTIALITY & NON-DISCLOSURE

Both parties agree to maintain strict confidentiality of all shared information.

Creative Nexus will not disclose client information unless:

  • Required by law
  • Approved in writing by the Customer
  • Required for internal production under confidentiality agreements

Confidentiality obligations survive for 2 years after contract completion.

12. LIMITATION OF LIABILITY

Creative Nexus is not liable for:

  • Loss of revenue or profits
  • Project delays caused by customer inaction
  • Business interruption
  • Loss of data
  • Any indirect or consequential damages

Our total liability shall not exceed the fees paid by the Customer for the specific project.

13. CUSTOMER INDEMNIFICATION

The Customer agrees to indemnify Creative Nexus against claims arising from:

  • Copyright violations in customer-supplied materials
  • Illegal or defamatory content provided by the Customer
  • Misuse of final deliverables outside the intended scope

14. TERMINATION

Either party may terminate the agreement by written notice.

Creative Nexus may terminate access immediately if:

  • Terms are violated
  • The user engages in harmful or illegal conduct
  • Misuse of the platform, files, or communication occurs

Payments already made are non-refundable (refer to Refund Policy).

15. CONTENT RESTRICTIONS

Users must not upload or transmit content that:

  • Is copyrighted without permission
  • Contains malware or harmful code
  • Is defamatory, obscene, hateful, or unlawful
  • Infringes intellectual property rights
  • Violates national/international laws

Creative Nexus reserves the right to remove such content immediately.

16. AMENDMENTS TO TERMS

Creative Nexus may update these Terms anytime.
Updated versions will appear on our website with a revised date.
Continued use of the Services indicates acceptance of updated Terms.

17. DISPUTE RESOLUTION

In case of disputes:

  • Both parties will attempt an amicable resolution within 15 days
  • Failing settlement, disputes will be resolved through arbitration
  • The arbitration will be conducted by a sole arbitrator appointed by Creative Nexus
  • Arbitration language: English
  • Jurisdiction & governing law: India
